1. Introduction
These Terms of Use ("Terms") govern access to and use of TriLinkr, including its websites, dashboards, candidate portal, employer portal, consultant portal, admin portal, APIs, onboarding flows, and related services (collectively, the "Platform"). By accessing or using the Platform, creating an account, submitting a profile, posting a job, submitting a candidate, applying to a job, using an onboarding code, or otherwise using any feature of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. About TriLinkr
TriLinkr is a recruitment technology and job marketplace platform that enables Candidates, Employers, Consultants, and authorised administrators to interact in relation to job postings, candidate profiles, applications, consultant-submitted candidates, job requests, profile management, onboarding, and related recruitment workflows.
Candidates may create profiles, upload resumes and profile information, apply for jobs, and manage their account.
Employers may create or manage company profiles, post jobs, review candidates, and manage recruitment workflows.
Consultants may request access to eligible jobs, submit candidates, and manage consultant-related recruitment workflows.
Admin users may operate platform-level user management, moderation, analytics, access control, and support workflows.
TriLinkr is not an employer, recruitment agency of record, background verification agency, payroll provider, legal advisor, immigration advisor, or guarantee of employment unless a separate written agreement expressly states otherwise.
3. Eligibility
You must be at least 18 years old to use the Platform.
If you use the Platform on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
You must provide accurate, current, and complete information and keep it updated.
You must comply with applicable laws, including employment, recruitment, privacy, intellectual property, consumer protection, anti-discrimination, tax, and information technology laws.
4. Accounts, Onboarding Codes, and Security
Some Platform features require account registration, authentication, onboarding code verification, role assignment, or administrator approval. You are responsible for maintaining the confidentiality of your login credentials, onboarding links, one-time codes, and account devices.
Do not share your password, OTP, onboarding code, admin access, or session credentials with any unauthorised person.
Notify us immediately if you suspect unauthorised access, account compromise, or misuse.
We may suspend or restrict access if we reasonably believe that an account has been compromised, misused, or created with inaccurate information.
Role-based access is granted at our discretion and may be updated, restricted, or revoked based on business, security, or compliance requirements.
5. Candidate Terms
Candidates are responsible for the accuracy of their profiles, resumes, educational qualifications, work experience, preferred locations, preferred work modes, contact details, and application information.
You must not submit false, misleading, copied, outdated, or unauthorised information.
You authorise TriLinkr to process and share your candidate data with relevant employers, consultants, administrators, and service providers for recruitment-related purposes.
You understand that job applications may be reviewed by employers, consultants, or authorised admins and that TriLinkr does not guarantee interview calls, job offers, employment, salary, or hiring outcome.
You must ensure that uploaded resumes, profile pictures, certificates, links, or attachments do not contain malicious code, unlawful content, or third-party confidential information unless you have permission to share it.
6. Employer and Company Terms
Employers and company representatives must use the Platform only for lawful recruitment, hiring, company profile management, and related business purposes.
You must provide accurate company information, job descriptions, work location, work mode, skills, salary information where displayed, experience range, and hiring requirements.
You must not post fake jobs, misleading job descriptions, discriminatory requirements, commission-only roles misrepresented as salaried roles, illegal opportunities, or roles that require unlawful fees from candidates.
You are responsible for recruitment decisions, interviews, offers, employment terms, background checks, statutory compliance, and candidate communications outside the Platform.
You must treat candidate information as confidential and use it only for the relevant recruitment purpose.
7. Consultant Terms
Consultants may access eligible jobs and submit candidates only through approved Platform workflows and only where they have the necessary authority from the candidate and any represented entity.
You must obtain candidate permission before creating or submitting a candidate profile, resume, contact information, or application on behalf of that candidate.
You must not submit duplicate, misleading, unauthorised, or fabricated profiles.
You must comply with applicable recruitment, placement, confidentiality, and data protection obligations.
Access to consultant-eligible jobs may be approved, rejected, suspended, or withdrawn at TriLinkr's discretion or as configured by employers/admin users.
8. User Content and Platform Licence
"User Content" includes profiles, resumes, job posts, company details, candidate submissions, application information, images, attachments, messages, notes, and any other content uploaded or submitted through the Platform.
You retain ownership of your User Content, subject to the rights granted in these Terms.
You grant TriLinkr a non-exclusive, worldwide, royalty-free licence to host, store, process, display, transmit, reproduce, format, analyse, and use User Content as necessary to operate, secure, improve, and provide the Platform.
You confirm that you have the rights, permissions, and lawful basis required to submit the User Content.
We may remove, restrict, or disable User Content that we reasonably believe violates these Terms, applicable law, user safety, third-party rights, or Platform integrity.
9. Prohibited Conduct
You must not use the Platform to:
Break any law or violate another person's rights.
Upload malware, spyware, harmful files, spam, phishing content, or content designed to interfere with the Platform.
Scrape, crawl, harvest, export, or misuse candidate, employer, consultant, or admin data without written permission.
Reverse engineer, bypass access controls, abuse APIs, overload systems, or attempt unauthorised access.
Post discriminatory, harassing, obscene, hateful, defamatory, threatening, exploitative, or fraudulent content.
Collect fees from candidates unlawfully or misrepresent recruitment opportunities.
Use the Platform to build a competing product or database without written permission.
Share confidential candidate or employer information outside the relevant recruitment workflow.
10. Recruitment Outcomes and No Guarantee
TriLinkr may help users discover opportunities, candidates, and recruitment workflows. However, TriLinkr does not guarantee the identity, suitability, qualifications, background, reliability, conduct, availability, employment eligibility, salary, offer, hiring outcome, or performance of any user, candidate, consultant, employer, or job posting.
Employers remain responsible for independent due diligence, interviews, verifications, employment contracts, statutory compliance, and final hiring decisions. Candidates remain responsible for evaluating job opportunities and employment terms before accepting any offer.
11. Fees, Plans, Taxes, and Payments
Certain features may be offered under paid plans, subscription packages, credits, listing fees, success fees, or other commercial arrangements. Any fees, billing cycle, refund terms, taxes, and payment obligations will be described in the applicable order form, invoice, subscription page, or written agreement.
Unless expressly stated otherwise, fees are non-refundable once the relevant service is activated or consumed.
You are responsible for applicable taxes, payment gateway charges, and statutory deductions where applicable.
We may suspend paid features for non-payment, failed payment, misuse, chargeback, or violation of these Terms.
Payment processing may be handled by third-party payment service providers subject to their own terms and privacy notices.
12. Communications
You agree to receive transactional, account, security, onboarding, application, job, support, and service-related communications through email, SMS, WhatsApp, in-app notification, or other contact channels provided by you. Marketing communications, if any, will be handled in accordance with applicable consent and opt-out requirements.
14. Third-Party Services
The Platform may integrate with hosting, authentication, database, storage, email, analytics, payment, communication, and other third-party service providers. We are not responsible for third-party services that we do not control. Your use of third-party services may be subject to their separate terms, privacy notices, availability limits, and technical restrictions.
15. Intellectual Property
The Platform, including its software, designs, workflows, dashboards, branding, content, databases, UI components, logos, documentation, and related materials, is owned by TriLinkr or its licensors. Except for the limited right to use the Platform under these Terms, no rights are transferred to you.
Do not copy, modify, distribute, resell, sublicense, or create derivative works from the Platform without written permission.
Do not use TriLinkr's name, logo, branding, screenshots, or marketing materials in a misleading or unauthorised manner.
Feedback or suggestions you provide may be used by TriLinkr without restriction or compensation, unless separately agreed in writing.
16. Suspension and Termination
We may suspend, restrict, or terminate access to the Platform, remove content, disable accounts, or block certain actions if we reasonably believe that:
You violated these Terms or applicable law.
Your account or content creates legal, security, privacy, operational, or reputational risk.
Your role, onboarding approval, subscription, or business relationship has ended.
Required information is inaccurate, incomplete, unverifiable, or unauthorised.
Suspension is necessary to protect users, the Platform, or third-party rights.
You may stop using the Platform at any time. Account deletion or data deletion requests will be handled in accordance with our Privacy Policy and Data Retention Policy.
17. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, TriLinkr disclaims warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, merchantability, accuracy of user content, non-infringement, and successful recruitment outcomes.
18. Limitation of Liability
To the fullest extent permitted by law, TriLinkr will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or loss-of-profit damages, including loss of data, business interruption, recruitment loss, lost opportunity, reputational harm, or unauthorised access caused by factors outside our reasonable control.
Where liability cannot be excluded, TriLinkr's aggregate liability for claims relating to the Platform will be limited to the lower of: (a) the amount paid by you to TriLinkr for the relevant paid service during the three months before the claim arose; or (b) Rs. [Insert cap]. This limitation does not apply where prohibited by law.
19. Indemnity
You agree to indemnify and hold TriLinkr, its affiliates, directors, officers, employees, contractors, and service providers harmless from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms, misuse of the Platform, unlawful recruitment practices, unauthorised data submission, User Content, or violation of third-party rights or applicable law.
20. Changes to the Platform or Terms
We may update the Platform or these Terms from time to time. We will update the "Last updated" date and may notify users of material changes through the Platform, email, or other reasonable means. Continued use of the Platform after changes take effect means you accept the updated Terms.
21. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
